U.S. State Privacy Notice

Effective: June 10, 2025

This notice provides additional information for users in certain states within the United States, based on privacy laws enacted in such states that provide for the privacy rights described below.   This notice augments our Privacy Policy, which also applies.  If any part of this notice conflicts with our Privacy Policy, this notice will control for applicable U.S. state residents.

Your Rights

Right to Know. You may have the right to request that we disclose to you the categories and specific pieces of personal information that we have collected about you, the categories of sources from which we collected your personal information, our business or commercial purpose for collecting, selling, or sharing your personal information, the categories of personal information that we have disclosed for a business purpose, any categories of personal information about you that we have sold (which we note here is none), and the categories of third parties with whom we have disclosed your personal information (linked here).  Please reach out to support@roosterteeth.com  to request additional details.

Right to Access. You have the right to confirm whether or not we are processing your personal information and access such personal information.  Please note this right might be subject to certain limitations.

Right to Request Deletion.  You have the right to request deletion of your data, unless an exception applies. Examples of exceptions include when we need to keep data to meet legal obligations, detect fraud, investigate reports of abuse or other Terms of Service violations, or fix security issues. Upon your verified request, we’ll delete your personal information (unless an exception applies) and will direct our service providers to do the same.

Right to Correct Inaccurate Personal Information. Taking into account the nature of the personal information and the purposes of the processing, this right provides you with the ability to seek to correct or update personal information that you consider incorrect.

Right to Know who we share your data with. We don’t sell your data or share your data for cross-context behavioral advertising, but we do share your information with service providers for legitimate business purposes. For example, we use service providers to store and host your data. See the Sharing Your Information section below for more details or navigate to this page for more about the specific parties with whom we may share personal information.

Right to Non-Discrimination.  We will not discriminate against you for exercising any of these rights.   Good that this is in a statute, but we will never do that in any event with any of our Community Members, no matter where they live.

Right to opt-out of targeted advertising.  As of the effective date of this Notice, we do not conduct any targeted advertising which would require cookies, and to the extent we provide any activity-based ads which do not require cookies, if and when we do, we will provide you with a way to turn that off and will further describe that here.

Right to opt-out of profiling. You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. With Rooster Teeth, there’s no need to opt out because Rooster Teeth does not do that.

Exercising Your Rights

You may exercise any of these rights by contacting us at support@roosterteeth.com and providing us with your name, email address and address (including zip code).  You have the right to make two free requests in any 12-month period. We will respond to your request within 45 days, and in more difficult cases we may extend our response time by another 45 days.  We may verify your identity by asking you to submit a request through your password protected Rooster Teeth account and by providing us with your zip code or other proof of residency in your state.

You can also authorize an agent to submit a request on your behalf.  An authorized agent must have your signed permission to submit a request on your behalf or provide proof they have your power of attorney in accordance with laws of the state in which you reside. Authorized agents that are business entities must be registered with the Secretary of State to conduct business in your state of residence. Where you use an agent, we will ask for verification of your authorization, namely a copy of your written authorization for the agent to submit the request on your behalf.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

We may deny certain requests, or fulfil a request only in part, based on our legal rights and obligations.

Your request must:

  • Provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of such person; and
  • Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

If we deny your rights request, and you live in a state that provides for this right, you may have the right to appeal that decision. We will provide you with the necessary information to submit an appeal at that time.

Information We Collect

As detailed in our Privacy Policy, we collect personal information for a wide range of purposes, but the main reason we collect information is to offer you the best possible products and services.  But, we make sure we don’t collect more information than necessary or collect information for purposes that are not what is detailed in our Privacy Policy.  All the types of the personal information described in the Privacy Policy have been collected in the last 12 months (that’s something California wants you to know).

California

We Never Sell Your Data.  Under the California Consumer Privacy Act as amended by the California Privacy Rights Act of 2020, (CCPA), "sale" is defined very broadly and includes a wide array of data sharing. As the term is defined by the CCPA, we do not "sell" your personal information.  Accordingly, we do not offer the ability to opt out, since you don’t need it.

Metrics On Your Rights. Transparency is important to us, especially when it comes to helping you understand and exercise your rights under the CCPA. We don’t have any metrics yet, but that’s why we will publish at then end of calendar year 2025 metrics on the following categories of requests and attach them here:

We don’t sell your data, so we don’t process, or collect metrics on, opt-out requests for the sale of consumer data.

Notice of Financial Incentives

We may collect your personal information in connection with certain special offers, discounts, sweepstakes, contests, or other promotions (collectively, “promotions”) that we may make available to you. Because these promotions may involve the collection of personal information, they may be interpreted as a “financial incentive” under California law or a “bona fide loyalty program” under Colorado law.

When you sign up for a promotion, we will provide you with relevant terms that apply to your participation in the promotion. To stop receiving promotions by email, you may unsubscribe by clicking the “unsubscribe” button at the bottom of any email. If you decline to provide your personal information or ask us to delete your personal information, we may not be able to provide you with access to these promotions.

The value of any financial incentive or bona fide loyalty program we offer is reasonably related to the value of any personal information that you provide to us. We estimate the value of your personal information by considering, without limitation, the expenses we incur from collecting your personal information and/or providing the promotions to you, and/or the revenue generated through the promotions.  We do not use the personal data for advertising (other than the promotions themselves) and we do not “sell” the personal data, we use the data for the sole purpose of providing the program’s benefits, and hopefully, encouraging your ongoing participation after the end of the promotion.
