EEA, UK and Switzerland Privacy Notice

Effective: June 10, 2025

This notice provides additional information for users in the European Economic Area (EEA), the United Kingdom (UK) and Switzerland. Community Members in the EEA, UK and Switzerland have certain privacy rights as specified under EU, UK and Swiss law, including the General Data Protection Regulations (GDPR) for the EEA, the UK GDPR and the UK Data Protection Act 2018 for the UK, and Federal Act on Data Protection (FADP) for Switzerland (we’ll refer to them as the “European Privacy Laws”).  This notice makes sure we cover the EEA, Swiss and UK-specific requirements under the European Privacy Laws and augments our Privacy Policy, which also applies.  If any part of this notice conflicts with our Privacy Policy, this notice will control for EU, UK and Swiss residents.

If you’re a Community Member in the EEA, UK or Switzerland, we are the controller of your personal information.  In accordance with applicable European Privacy Law, we have appointed representatives within the EU, the UK and Switzerland.

Rights of Access, Deletion, Correction, and Portability

You are entitled to certain rights under the applicable European Privacy Law. These rights give you greater control over your personal data and how we use it.

Right of Access.  You can request access to the personal data we hold about you, which may include information related to your account details, viewing history, preferences, and usage patterns.

Right to Rectification.  If your personal data is inaccurate or incomplete (e.g., an outdated email address or incorrect profile info), you have the right to request that we correct or update it.  Usually, you can correct that yourself through your account profile.

Right to Erasure (Right to Be Forgotten).  You can ask us to delete your personal data in certain circumstances, such as when:

  • You no longer wish to use our Service;
  • The data is no longer necessary for the purpose we collected it;
  • You withdraw your consent (if applicable);
  • You object to the processing and there are no overriding legitimate grounds.

Please note that we may retain certain information as required by law or for legitimate business purposes (e.g., fraud prevention or legal obligations).

Right to Data Portability.  You can request a copy of the personal data you have provided to us in a structured, commonly used, and machine-readable format. Where feasible, we can also transmit this data directly to another service provider at your request.

Right to Restrict Processing.  You may request that we temporarily limit the processing of your data, for example:

  • If you dispute the accuracy of your data;
  • If you object to our use of your data and we are considering your request.

Right to Object.  You have the right to object to the processing of your personal data when we process it based on our legitimate interests (e.g., for service improvement or analytics). You also have the right to object at any time to the use of your data for direct marketing purposes.

Right to Withdraw Consent.  If we rely on your consent to process any of your personal data (e.g., for detailed location data or marketing communications), you may withdraw your consent at any time.

How to Exercise Your Rights.  To exercise any of these rights, please contact us at support@roosterteeth.com . We may need to verify your identity before fulfilling your request. We aim to respond to all requests within one month in accordance with European Privacy Law requirements.

International Data Transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. Specifically, our servers are located in the United States, our headquarters is in the U.S. and third party service providers operate around the world.  This means that when we collect your personal information, we may process it in the U.S. We may also transfer data from the U.S. to the EEA and/or from the EEA to the U.S. You can find more information on the categories of third parties we share information with here.  In case of third party service providers, we rely on the European Commission’s Standard Contractual Clauses as issued on 4 June 2021 under Article 46(2) used  for controller to controller and controller to processor  transfers, including the UK Addendum or the UK International Data Transfer Agreement permitted under Article 46(2) of the UK GDPR for the transfer of data originating in the UK,  and modified for Swiss requirements and, for any such international transfers.
