Honestly, I don't think Epic has any ground to stand on. Sure, the 30% cut does make things harder for smaller indie devs, but when you agree to the rules and then intentionally try to circumvent or ignore the rules, you're going to face consequences for it. It's like playing an MMO and then getting banned for a couple days for breaking a rule, only to then bitch and moan about how it's not fair(I've seen this bullshit a lot). You agreed to the terms. If you don't like it, go somewhere else.

The biggest issue Epic is getting at is that low level developers are getting the shaft when it comes to trying to get off the floor on Apple's platform. Taking a third of someones earnings can be devastating at an individual's and even small group level of developers, sure it makes more sense at greater levels but if they want new ideas and games, they need to reign the amount back for them if they want new honest growth from other sources. Basically asking in a term we can all understand. "What if I took a 3rd of the amount of sleep you were getting at this point from here on and you had no say in it?" would you be pissed? I know I would.

@Howiepenguin You don't actually believe Epic gives a shit about smaller developers. They don't. They care about the money other devs pay them for using Unreal. And like the judge rightfully said, outside of Epic's own PC store, taking 30% is the industry standard. It's the same cut Steam, Microsoft etc. take in their stores. Epic really doesn't have a leg to stand on

It feels like the biggest hurdle is going to be showcasing how Apple has a monopoly. Epic can argue that the market for apps on Apple products is exclusively the App Store, but the problem is that Fortnite is on other platforms and the market for Fortnite is not just the App Store but also Google Play Store, Playstation Store, etc., which I think is the route Apple is taking. I agree that the outcome of Epic winning would be a win for smaller dev teams to be able to receive a (deservedly) larger pay from their work, which is great. But at this point I don't think Epic can prove that there's a need to break up the existing monopoly on iPhones, and I'm not sure I see a way for any developer to prove that with the multitude of platforms a developer has the choice to publish on.
