The way I see it. All these fan games are simply trying to take advantage of an existing IP to showcase their own programming/art/development skill. But they know unless they hit it out of the ballpark nobody is going to give a shit about their new IP attempt. It's sad but true a lot of times.
The solution? Make a "fan game" to showcase some new style of gameplay with an established IP overlay. What to make a 2D over the top adventure game? Why not make a Zelda "fan game" based on BoTW! How about a Metroidvania style game? Why not the Metroid people have been asking for?
And then once the project gets C&D after it got steam, now the person reveals their new original IP that is similar to the previous "fan game".
I don't think he's that far off. It's true that a lot of the reasoning behind making a fangame in the first place is passion/nostalgia-driven with no monetary gain in mind. But I'm fairly certain that another significant part of it is for people to expand their creative and programming skills and be able to say "hey, I did that" afterwards as a way of showcasing their capabilities.
@Phatnaru Well yes, of coarse I'm making assumptions. Every project will be different as are the reasons for them trying to complete it.
But my point is why waste the time and energy to develop a fan game, when you can take that inspiration to create something original. After that there's nothing really stopping you from placing an homage or nod to the source of that inspiration.
To my knowledge Project M wasn't actually DCMA'd at least not officially. But the team behind it realized that if they truly wanted to move forward as being a game developer they'd have to drop the project and move on with an original IP to make money and better fund themselves.

Wow didn't expect Woolie's content to be news. Any fan of the zaibatsu knows all of their content are light hearted and are not meant to be taken seriously. Sure video game lawyer does good things informing the public about the law but thinking that video has serious consequence, really?
its even worse when you know how woolie describes his own channel and how next to that you get a "i hate my life why i am doing this" naruto playthrough and bad greenscreen videos.
im shocked anyone took that video as serious advice.
Don't do it kids. Just make your own IP.
