Nintendo's never had a positive relationship with ROM communities, but now they're taking 2 sites to court for more than $100 million over Nintendo ROM distribution
Personally, I really okay with nintendo pursuing this. Piracy tends to have damaging, top down, long term effects, and ROM distribution sites are clearly thriving because internet law hasn't caught up yet. That said, piracy is usually the result of lack of availability. If nintendo executed a good solution for the availability problems that old games have, they wouldn't have to spend as much of their time dealing with piracy. However, them not addressing availability does not entitle us to steal the games either.
Market harm yes, but how would it be market harm if they don't sell the game anymore ? Is it because they are bringing it back? Selling them again because if not then i wont stop

@woohaa Don't bring that crap here! For the record, I wasn't at all offended; I'm just growing tired of people talking about this on entertainment programs, and I have a really hard time at moments telling whether any of them are jokes or genuine complaining.

Ok first of all, the most important part of a lawsuit is proving monetary harm. Nintendo would have to establish they are losing money from these sites making Roma available. The problem with that is there is no evidence these sites have hurt demand for Nintendo’s games to any real level. At least not to the point where Nintendo’s supply is not meeting demand.
@conundrum32068 Accidently hit send. Their NES and SNES classics are perfect examples of both how they cannot show monetary harm, and how they are not providing alternative pathways to this material. Both systems sold out immediately, Nintendo didn't make nearly enough of them. With this being the ONLY way Nintendo has made this product available, and both selling out entirely, how can they establish harm? They can't.
Who wants to bet that at some point during the development of any of their mini consoles, they needed a copy of an old game (glitches and all), but they didn't have it for whatever reason and went to one of these sites to get a copy?
most of the ROMs i get are GBA and original DS games. mostly because their just not manufacturing them anymore. and there is no way i can get some of the ROMs I want currently. Like Pokemon Typing Adventure, not going to see that anywhere but the internet, and the only way I can get it is through a used copy. By then someone has already bought the game directly from Nintendo and I can't support them with buying a used copy either since all that money goes right to the re-seller. If Nintendo makes a downloadable copy I can play, I will. I have done that with the first gen Pokemon, now I just need the rest on my Switch. I am such a sucker for re-buying games, if its there for me to buy that is.
(Nintendo, please give us Wind Waker HD and Twilight Princess HD on the Switch)
