So if I'm understanding this right, based on the fact that "Escape from Lavender Town" wasn't taken down, Nintendo only ran a search on Gamejolt for "Pokemon." So that means just dont name your game after the source material. Don't have "Pokemon" or "Mario" or "Zelda" in the title

To understand, let me take you back in time a few years, to the dawn of Google's android brand...

Android, up until late 2015 or early 2016, ran on the framework of Apache Harmony, a clean room implementation of the Java SDK, which is owned by Oracle.
Oracle, understandably, sued the fuck out of Google. Unfortunately the judge and jury got a bug up their collective asses, and decided that, basically, Oracle had no rights to it since they took so long to file the lawsuit in the first place. They had taken a few years after the creation of android before trying to stop the whole thing and protect their copyright, see. Eventually, some tie last year, a judge overturned the ruling, and Google had to finally stop using Oracle's shit in their product without paying, and thus they removed Oracle's code entirely.
Copyright lawyers obviously noticed this, hence why Nintendo HAS to do this sort of thing. If they don't, some jerkass pirate *cough*LIKEGOOGLE*cough* might come along and use their IP to make a huge profit and Nintendo would have no legal recourse to stop it.
To add a bit of fun information to this, Google is facing monopoly charges over Android in Europe, due to their giving away Android for free to any manufacturer who wants it, as well as forcing their whole suite of software (hey google, google play, etc.) to be on the device. So much for their company line of "You can make money without being evil," eh?

I realize this may not be a popular opinion, but I understand why Nintendo did this. I don't like that they had to, but it had to happen. People are making fan content based on their intellectual property, and having someone else use that content- whether or not it is intended to make a profit- makes it difficult for them to keep their own copyright. Nintendo is completely in the right to do this, and even though it's not a popular thing to have happen- it has to for them to continue making the content themselves without having to worry about the IP being destroyed by some poorly made fangame that hinders the name of something they make. I'm sorry it's happened, but also not surprised.
I agree with you. Nintendo is not a company to screw around with. Since AM2R got shut down, I came to respect Nintendo's policies as well as knowing that making fan games as well as making parodies or even going as far as making a parody shirt is considered an serious offense.

Makes sense Nintendo would go after all these people. Plus I feel like if you are going to make a game that is basically the same as another IP owned by a big company or anyone else you kind of are risking a DMCA take down. The risks kinda out weigh the rewards imo. But it would make sense for Nintendo to make a hub similar to what blizzard does so a bunch of indie devs can use a bunch of source material while still absolutely being controlled by Nintendo. There is a StarCraft MMO thanks to the fact blizzard gives devs a place to create games without the risk of getting sued.
On the NX I'm with Ryan, the NX sounds great on Paper but I'm sure a lot of people said the same about the Wii U. I'm going to be skeptical about the NX till about a year and half after launch cuz I'm sure the hype will disappate by then and I can finally get a clear sense of how 3rd party devs feel about the console.

Really it's kind of sad how much talent goes toward fan projects. Not that they aren't amazing, but we could have so many more amazing IPs if people used their creative talent to make their own things.
the reason people are afraid to make new ip is due to there is no guarantee fan base for it. you make a new platform game people are like oh, call it super mario amazing platform extreme and people are going to buy it with little knowledge because it has mario in it.
Well fan projects are fine and dandy and a lot take serious talent but if you're going to use all or even most of your talent on that, I feel like it's a waste. Do it for your passion, not for your fandom.
The least you could do is come up with an original username.
