I've been a long tome fan of Out There, bought it at PAX East one year, and the similarities to No Man's Sky were a selling point for me. I described it to my brother as a 3D Out There. Yes-you discover alien races, although its a good bit harder in Out There and you also visit planets, but the core gameplay of Out There is pretty dang different. I think there are similarities in that it is a space exploration game with aliens and inventory management, but nothing other than that. The ships in OT have fixed storages, whereas the storage of No Man's Sky ships vary widely. Additionally, you never get out of your ship in a controllable way in Out There, whereas that is most of No Man's Sky.

I was such a huge fan on out there when i found it last year, maybe that's why i played no mans sky for 30 hours in two weeks. which is crazy for me. plagarism is a silly word considering all games are incredibly alike. Out there is far more challenging though.

I don't think anyone was saying it was a "rip off" here. Plagiarism doesn't necessarily mean you've copied the entire work. With Art as complex as a video game it does get complicated, I don't really know how plagiarism works outside of research papers, so I don't really know how best to judge this one, but don't base it on whether you think the entire game has been ripped off.
Of all the gameplay mechanics to steal, why would you copy the inventory management system? That was one of the worst parts of No Man's Sky for me. It seems like half the mods being worked on are fixing that mess.
Having an entire universe simulation is not too crazy of an idea, and now when games like that are only starting to be possible, it's not surprising two games of the sort exist.
