I don't think they should be able to trademark the word "react" as its too common in the YouTube "vernacular". Like Burnie pointed out on the RT Podcast, if it were more specific, or more brandish, that wasn't as broad and confusing then I doubt this would've been an issue at all.
Monty at the end gave me some feels.
So if you Roosterteeth used "react" would that be okay since you and The Fine Bros both have the same parent company?
RIP MO
Depends on who owns it... if it's The Fine Bros then it's their choice (though with a trademark if they didn't defend it from RT then they might lose it) - it wouldn't be the first time that sort of thing has happened!
So if they are able to trademark a term so common as "React", does that mean that someone can trade mark "Funny Moments" or "Fail Compilation"? Seams beyond stupid to me to be able to do this.
You can trademark anything, it's just a problem of actually disputing anyone who uses it. Like when King (makers of Candy Crush) tried to trademark the words "Candy" and "Saga"
Shout out to that clip of Courtney Act on Australian Idol
Any reaction is derivative by definition and thereby usus et fructus. You, Fine Bros, habeas corpused many a novus homo in front of a screen. Then legally recorded the reaction to the ex post facto content. With revolutionary albeit de jure camera angles. That's your truly groundbreaking idea. Unique recording format in line with the heretofore aforementioned legal fowl precedent. For years, it seemed like so much trailblazing, primum non nocere fun. Then, you [Fine Bros] attempted to claim broad rights over reactions. Alas, humanum est errare. Here's a reminder of the good old days. That was, me judice, always my favorite. This self inflicted REACTastrophe appears to be a salto mortale. In dubio, it couldn't have happened to melioribus popularibus. Move to strike. Good, community aware people will ape Burger King or McDonalds whenever, wherever they can. I want to thank the Fine Brothers personally for giving us another kerfuffle in a world already brimming with clusterfucks. Do we need more? Just ask Joel! The oil prices and the gold and what have you...they are all connected to wider clusterfucks. Greed is NOT fine, bros. You have forced our hand in this ultima ratio regum! All you have earned is the contemptus mundi when you should have sought jutitia omnibus! I have one final question: cui bono? On the bright side, post mortem quidem sensus aut optandus aut nullus est. Amirite?! I rest my case. Yield unto Caeser, bitches. When I think about fun, I think about it in Latin legalese!
Nice - and don't be discouraged by the lame people voting you down because they don't understand Latin :)
Why did they have to put the Monty tribute at the end of this video? I did not need to be sad right now but just that first 5 seconds was enough to make me sad for an hour.
I would like to say that I don't necessarily care about either the Fine Bros.' or the internets well being, and I'm sure both sides want the best for everybody, but miscommunications happened and suddenly everyone's an asshole. I don't care.
What I do care about is the story itself, I wanted to enjoy this piece and learn about everything that has been going on. Problem is, I could NOT do that.
Why? That goddamn 'chaching' bite every 2 seconds.
Person who edited this: why did you feel that during a 12 minute news piece it would be hilarious to put that soundbite every time someone sneezes or says "React"? Why did you believe, that by spending an extra 30 minutes on editing in that sound, you suddenly gave something of value to the video? This is a 12 minute video. Not a 5 minute infotainment piece, but a more "in-depth" one.
Don't take this the wrong way - I'm not defending the Fine Bros.' integrity, I'm only saying that after 6 minutes I literally couldn't keep up with what Ashley and Gray was saying (and no I'm not mentally incapable I just like to enjoy these vids from the background, while working).
This was not creative, not funny, not fitting and not what I expect from these kind of vids.
If anyone actually read all this (and frankly I don't know why you would do that): Thank you for reading, and I hope we can enjoy every piece of news we receive from now on.
I can't believe it's been a year already.....
this act is absurd especially the 60/40 split in profits, you don't get 60.
The odd thing I fined is that having watched a few of the different series' The Fine Bros produce I don't see much of a format or brand to trademark; each series is a little different such that across the range they vary quite a lot and to cover the whole lot they would indeed own a good chunk of what might ever be possible in terms of filming reaction videos - especially when the language used to do that would end up including more than they already produce...
For what it's worth I don't think they will be given it and even if they are they won't be able to make it stick - this is the internet, if you can enforce something here then you're doing really, really well and/or know/own one of the major powers of the world (which includes more corporations than governments).
Legal is, despite what rule makers would like you to think, a mutable entity on the internet with at least as much grey area as black and white courtesy of different countries having different laws - ironically some of this stuff is getting so close to the core of human expression that I'm sure some people are starting to consider it a breech of freedom of speech... that'll be a fun fight!
And, yes, I have made sure to clean out all my bookmarks to The Fine Bros (just like I do every time so entity trolls infront of the whole internet - Don't Feed The TROLLS).
